Zusammenfassung
In den letzten Jahren wird zunehmend ein Mangel an adäquater Arzneimittelforschung
für Kinder beklagt. Die vielfältigen Ursachen für diese Entwicklung (ökono-misch,
rechtlich, ethisch und methodisch) werden ebenso diskutiert wie individuelle und politische
Reaktionsmöglichkeiten. Die derzeitige Praxis des off label use wird kritisch dargestellt.
Die globalen Begriffe »spezielle schutzwürdige Populationen« oder »einwilligungsunfähige
Patienten«, welche seit dem Nürnberger Kodex in verschiedenen internationalen medizin-rechtlichen
Dokumenten gebraucht werden, werden in ihrer Problematik für Kinder diskutiert.
Summary
In the last few years a political debate on lacking treatment research to the benefit
of children rose all over the world. The multiple reasons for this situation (children
as therapeutic orphans) like economic, legal, ethical and methodological practice
are discussed in this paper. A critical review of the consequences of the so called
»off label« and »unlicensed use« is given. With respect to the ability of children
to understand research issues and to give assent we criticize a global concept of
»special populations« used in many ethical-legal papers. It is not helpful to apply
the same mechanisms to Alzheimerpatients, mentally retarded people, prisoners and
children.
