Ethische und rechtliche Aspekte des Plazeboeinsatzes in Forschung und Praxis

Abstract

The discussion of ethical and legal problems concerning placebo application is suggested as an essential constituent of modern placebo research. Implications of distinctions between inadvertent and intended placebo applications and between single case and sample applications of placebos are examined. Implicit hypotheses of placebo applicators (investigators, practitioners) on the indications and contra-indications of placebos are confronted with empirical data which are still limited, however. Differentiation between several levels of information given the placebo recipient about the real nature of the placebo application is suggested and pro and contra of each level will be discussed in detail. In the following ethical and legal aspects of placebo application in practice (with clinical patients) and in research (sample tests) are elaborated. Finally actual issues of law concerning placebo applications in the Federal Republic of Germany are discussed.

Zusammenfassung

Die kritische Auseinandersetzung mit ethischen und rechtlichen Problemen bei Plazeboanwendung wird als notwendiger Bestandteil der modernen Plazeboforschung aufgefaßt. Implikationen, die sich aus den Unterscheidungen zwischen versehentlichen und absichtlichen Plazeboapplikationen und zwischen dem Masseneinsatz von Plazebos und ihrer Anwendung im Einzelfall ergeben, werden erörtert. Implizite Hypothesen über Indikations- und Kontraindikationsbereiche von Plazebos aus der Sicht der Anwender (Forscher, Praktiker) werden der empirischen Befundlage, soweit dies auf der Basis der noch sehr begrenzten Daten möglich erscheint, kritisch gegenübergestellt. Bei der Frage, wie weit Plazeborezipienten aufgeklärt werden sollten, wird zwischen mehreren Informationsebenen unterschieden und deren jeweilige Vorzüge und Nachteile diskutiert. Anschließend werden ethische und rechtliche Aspekte beim Plazeboeinsatz in der Praxis (klinische Patienten) und in der Forschung (Stichprobentests) erörtert. Den Abschluß bildet ein Blick auf die Rechtslage bei Plazeboanwendung in der Bundesrepublik Deutschland.
