Zusammenfassung
Nach einer Einführung in bisherige Etappen der Etablierung von Menschenrechtskonventionen
wird dargestellt, warum das Thema der Wahrung von Menschenrechten für die Medizin
an Aktualität gewonnen hat. Im weiteren werden die in deutsche Gesetzgebung implementierten
Menschenrechtskonventionen und die dort für Gesundheitsbelange verankerten Rechte
benannt, deren Bedeutung für die Psychiatrie aufgezeigt und davor gewarnt die Diskussion
um die Wahrung von Menschenrechten auf Unterbringungs- und Zwangsmaßnahmen einzuengen.
Sodann wird analysiert, ob die Wahrung von Menschenrechten chronisch psychisch Kranker
messbar ist. In Psychisch-Kranken-Gesetzen der Bundesländer definierte Besuchskommissionen,
das Europäische Komitee zur Verhütung von Folter und unmenschlicher oder erniedrigender
Behandlung oder Strafe sowie der Europäische Gerichtshof für Menschenrechte werden
als Instanzen vorgestellt, die auf die Wahrung von Menschenrechten in der Psychiatrie
achten. Geschlussfolgert wird, dass die Rezeption von Menschenrechtskonventionen in
der deutschsprachigen Psychiatrie intensiviert werden muss und dass Effekte der Wahrung
von Menschenrechten auf die seelische Gesundheit zu untersuchen sind.
Summary
The introductory section of the paper briefly explains the different historical steps
of establishing Conventions of Human Rights, and demonstrates that human rights have
recently gained importance for the field of health care. Further, the paper introduces
the Conventions of Human Rights implemented in German law and outlines those rights
which are related to health (care). Analyzing the relevance of these rights for psychiatry
leads to the conclusion that the current discussion on the protection of human rights
must not be reduced to the issues of involuntary hospital admission and coercive measures.
The challenging problem how to empirically assess the protection of human rights of
chronically mentally ill persons is briefly addressed. Inspection teams as defined
in the mental health acts of the German Laender, the European Committee for the Prevention
of Torture and Inhuman or Degrading Treatment or Punishment, and the European Court
of Human Rights are important bodies which pay attention to the protection of human
rights. The paper’s main conclusions are that the reception of Conventions of Human
Rights in German psychiatry needs to be intensified, and that effects of human right’s
protection on mental health (care) need to be (scientifically) assessed.
