The subject of this presentation will be to discuss the legal tools available to local law enforcement for investigating and prosecuting dietary supplement fraud. Topics will include the obligation of advertisers to substantiate advertising claims made for dietary supplements, what constitutes adequate substantiation, and how the failure to substantiate makes a claim deceptive and therefore illegal. Other topics include; when do advertising claims convert a dietary supplement into an unapproved drug, misbranded drugs and foods, and the impact of California's Proposition 65 on this area.
